Important. These Terms & Conditions (“Terms”) govern your access to and use of this website (the “Site”) operated by Vivek Kumar Coaching (“we”, “us”, “our”). They are a generic template. You should have them reviewed by qualified legal counsel for your specific business before relying on them.
By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
The Site presents information about coaching and related services. Vivek Kumar may be identified as the individual providing those services. References on the Site to “coaching” or “sessions” are descriptive only and do not, by themselves, create any contract.
Services described on the Site (including mindset, transformation, or life coaching) are not medical, psychiatric, psychological, or emergency services. They are not a substitute for diagnosis, treatment, or care by a licensed healthcare professional. If you are in crisis or may harm yourself or others, contact local emergency services or a qualified clinician immediately.
Using the Site, submitting a form, or sending a message does not establish a paid coach–client or other professional relationship unless and until we separately agree in writing (or as otherwise clearly stated at the point of purchase or booking) and any required fees are paid where applicable.
You represent that you are legally able to enter into contracts in your jurisdiction and that any information you provide is accurate. If you use the Site on behalf of an organisation, you represent that you are authorised to bind that organisation.
Fees, payment methods, session length, rescheduling, refunds, and cancellation rules are as stated at the time you book or enrol, or in a separate agreement. If nothing is stated online, they will be communicated directly and apply only once agreed.
Content on the Site (text, graphics, logos, layout, and other materials) is owned by us or our licensors. You may not copy, modify, distribute, or exploit it without our prior written consent, except for temporary browsing and printing a reasonable copy for personal, non-commercial reference.
The Site may link to or embed third-party services (for example scheduling, messaging, or video). Those services have their own terms and privacy policies. We are not responsible for their content or practices.
You agree not to misuse the Site: no unlawful activity, no harassment, no attempt to gain unauthorised access to systems or data, no transmission of malware, and no scraping or automated access that imposes an unreasonable load, except as allowed by applicable law.
The Site and its content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by applicable law, we and our team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site or services, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Site shall not exceed the greater of (a) the amount you paid us for the specific service giving rise to the claim in the three (3) months before the claim, or (b) Indian Rupees five thousand (INR 5,000), unless mandatory law requires otherwise.
You agree to indemnify and hold harmless Vivek Kumar Coaching and its representatives from claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site, to the extent permitted by law.
These Terms are governed by the laws of India. Subject to mandatory provisions, courts at a competent location in India shall have exclusive jurisdiction over disputes, unless we agree otherwise in writing.
We may update these Terms by posting a revised version on this page with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance of the updated Terms, where permitted by law.
